Written to be read, not to be survived. The two things worth knowing before you pay: your download link is time-limited, and because a recording is delivered instantly there are no refunds once it has been sent. If it doesn't work, or never arrived, that is a different matter entirely and I will fix it.
1. Who you're buying from
Hypnosis MP3 Shop is operated by Boris Cherniak, a sole trader in Ontario, Canada. Contact: sales@hypnosismp3shop.com or the contact form. In these terms, "I" and "we" mean that business, and "you" means the person buying.
Placing an order means you accept these terms and the privacy policy. If you don't accept them, don't buy — nothing here obliges you to.
2. What you're buying
Digital audio recordings, delivered as MP3 files by download. Nothing is shipped; there is no physical product, no CD, and no subscription. You are buying the specific recordings you select, at the price shown at the time of purchase.
Prices are in the currency shown at checkout and include or add tax as displayed there. I may change prices or withdraw a recording at any time, but never retrospectively: what you paid is what was on the page when you paid it.
3. How delivery works
Payment is taken by PayPal. As soon as PayPal confirms it, the shop emails a private download link to the address you entered at checkout, and shows the same links on screen — deliberately, so that a purchase is never lost to a mail problem. Save the file when you get it.
Download links are time-limited. Each link:
- expires 168 hours after it is issued;
- works up to 7 times;
- is private to you, and should not be shared or posted — anyone holding it can take the file.
That is not a trick to make you lose access. If a link expires or runs out, get a fresh one instantly from the resend page using the email address you bought with — free, as many times as you need, for as long as this shop exists. Nothing you have paid for expires. Only the link does.
Deliveries land in spam more often than anyone would like. If nothing arrives, check there first, then use the resend page, then write to me. I answer these personally.
4. Refunds
Because these are digital goods delivered immediately, all sales are final and there are no refunds once a download link has been issued. A recording cannot be returned — by the time you know whether you want it, you have it. By buying, you ask for delivery to begin at once and accept that this ends any statutory cancellation right you would otherwise have for digital content.
That is the rule. Here is what it does not cover, and where I will always put things right:
- The file is faulty — corrupt, truncated, silent, or not the recording described. Tell me and you get a working file or your money back.
- Nothing was ever delivered and the resend page can't help you. Same: fixed or refunded.
- You were charged twice, or charged for something you didn't order. Refunded in full.
Write to sales@hypnosismp3shop.com from the address you used at checkout. Nothing in this section limits rights your local consumer law gives you and that cannot be signed away — where those conflict with anything here, your law wins.
Before buying, listen to the free samples and read the guide to what hypnosis MP3s can and can't do. It exists partly so that fewer people buy the wrong thing.
5. What you may do with a recording
Your purchase buys a personal, non-transferable licence to listen, for as long as you like, on any device you own. Copy it to your phone, back it up, listen a thousand times — that is all intended.
You may not:
- share, upload, sell, lend or give away the file or its download link;
- play it to clients, groups, classes or an audience, or use it in any commercial setting;
- edit, remix, sample or transcribe it, or use any part of it in your own work;
- strip it of identifying information, or present it as anyone else's.
Copyright in the scripts, recordings, voice, music and site text remains with Boris Cherniak. If you want a recording for group or professional use, that is a perfectly reasonable request — ask me and we'll arrange it properly.
6. This is self-help audio, not medical treatment
Important enough to state plainly. These recordings are for relaxation and self-improvement. They are not medical or psychological treatment, they are not a substitute for care from a doctor or therapist, and they are not intended to diagnose, treat, cure or prevent any condition. No outcome is promised, because no honest one can be: people respond to hypnosis differently and some people barely respond at all.
Never listen while driving or operating machinery, or while doing anything else that needs your attention — the recordings are designed to make you drowsy. Listen somewhere you can safely fall asleep.
If you have epilepsy, a psychotic illness, a dissociative disorder, or are under psychiatric care, talk to your doctor before using hypnosis recordings. If you are receiving treatment for anything these recordings touch on, treat them as an addition to that care and not a replacement for it. The safety section of the guide goes into more detail, including the research that is weaker than my profession usually admits.
7. Liability
I stand behind the recordings being what they are described as, and behind delivering them to you. To the fullest extent the law allows, I am not liable for indirect or consequential loss, for lost profits or data, or for any outcome you did or didn't get from listening. Where liability cannot be excluded, it is limited to what you paid for the recording concerned.
Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
8. The site itself
I try to keep the shop available and accurate, but it comes with no guarantee of uninterrupted service — hosts go down and payment providers have outages. Descriptions and prices are maintained carefully; if an obvious error slips through (a price that is plainly wrong, say), I may cancel the order and refund it rather than be held to a mistake.
Don't attempt to break into, overload, scrape or interfere with the site, and don't try to reach files you haven't paid for. Accounts and links involved in that get revoked without a refund.
9. Changes to these terms
These terms may change, and the date at the top moves when they do. The version that applies to your order is the one published when you placed it, not whatever appears here later.
10. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you buy as a consumer elsewhere, this does not deprive you of the protection of mandatory consumer law in your own country.
